You need a lawyer when you buy or sell in Spain

It is a great idea to buy a property in Valencia, but it can be a stressful operation, especially if you do not speak Spanish. The bureaucracy is also really different from other countries. You need a lawyer who speaks your language and who can explain every step of the process in detail.

Blue Key has a legal department that represents both sellers and buyers. However, for obvious reasons, we never represent both parties at the same time. We either represent the seller or the buyer. For apartments listed on this website we usually represent the seller, but of course we can bring the buyer in touch with an independent 3rd party lawyer if required.

Obviously you need to cover your back when you invest in Spain. You can not rely on the promises or intuïtion of the numerous real estate agents and property hunters that are reaching out to potential buyers. When buying a property in Spain it is hardly recommendable to hire an independent lawyer to minimize the risks.

Risk management consist of:

  • Checking whether the property has debts (mortgages, debts with the community, etc.).
  • Checking whether the seller is actually the owner or there is some issue with the registered ownership. It is not always easy to identify the owner of a property.
  • Checking whether the property is legally built and the plot size is correct.
  • Checking whether there is some right from a third part which could affect the property. 
  • Checking if there is some opened file at the Administration which could affect the property.
  • Checking at the Tax Administration if there is some file for outstanding payments. 
  • Checking whether the property serves your needs or expectations (Suitability for living, licences, energetic certificate,…).

  1. Land register information. We make sure that the information is correct by checking with the Dirección General de Registros y Notariados, and looking for potential registered issues.
  2. Due diligence: checking of debts and potential legal, urbanistic or financial problems/items.
  3. Writing/ editing/ clarifying all the standard documents from the first contact with the real estate agency/owner (reservation, arras and purchase deed)
  4. Check the necessity of previous debts cancellation and be sure about the registration of the current property status.
  5. Bank account opening and NIE obtention.
  6. Checking and preparing the draft of the purchase deed with the Notary.
  7. Assistance on the finanting obtention.
  8. Being in contact with banks to prepare all the financial details for the purchase completion.
  9. Personal assistance the day of the purchase signature at the Notary.
